Employee Handbooks
Employee handbooks are one of the foundational documents that define an employment relationship. Employers and employees alike refer to the handbook for company policies and employees’ rights under the law. Inaccurate or out of date handbooks may create misunderstandings about the rights of the parties, or may violate labor law by suppressing employees’ right to engage in protected, concerted activities under the National Labor Relations Act. Drafting a handbook requires a very thorough comprehension of the most current laws and regulations of the state or jurisdiction. Our knowledge and experience in labor and employment law allow us to provide clients with comprehensive and detailed employee handbooks, individually tailored to business needs and desires of the client.
Employee Practice Audits
Many employers make the mistake of assuming they are in compliance with federal, state and local employment laws. In two to three hours, we review a variety of legal topics with clients in order to pinpoint where their business/organization is in compliance and where practices may need to be modified. We prepare a detailed report summarizing the results of the audit process and recommending next steps in priority order. This report is a roadmap toward employment law compliance.
Employee Discipline
We counsel our clients on their ability to discipline employees for violating company policies. However, various legal restrictions may protect certain employees from being disciplined, or govern the manner in which the discipline is carried out. We advise our clients on ideal disciplinary practices that protect the rights of employers, while avoiding violating laws regarding discrimination, whistleblower protection, retaliation, and union activity.
Performance Appraisal
We often assist our clients in preparing state-of-the-art performance appraisals and the roll out of new appraisal forms. In addition, we counsel clients on issues relating to the quality and required honesty demonstrated in completing performance appraisals as they relate to performance issues that arise.
Hiring and Firing Issues
Federal, state, and municipal law creates a wide array of restrictions on the hiring or termination of certain employees or applicants. Each jurisdiction governs unlawfully discriminatory practices, criminal or consumer credit background checks, retaliation, whistleblower protection, disability accommodations, mass reductions in workforce, and several other areas of law. We assist in crafting hiring and firing policies that conform to these laws, and advise clients before making employment decisions that may potentially create future disputes.
Workplace Privacy
As technology and media continue to develop and be used in new ways, the law evolves to address new issues. When creating or enforcing policies, employers must be cautious not to violate laws regarding telephone or e-mail monitoring, video surveillance, sound recording, and social media privacy. Our firm remains current on workplace privacy laws, and we keep our clients well-informed on contemporary issues.
Job Performance
We counsel clients in employee relation situations that involve performance issues. We also help employers to identify weak performers when considering reductions in force.
Social Media Policies
The National Labor Relations Board (NLRB) has made a number of recent decisions addressing how employers might be infringing upon employees’ right to organize by creating broad policies against the use of social media. We stay current on these decisions to tailor our clients’ policies in a manner that is compliant with the law but also best protects the interests and rights of the clients.
Business Codes of Conduct
Our firm prepares comprehensive Business Codes of Conduct that cover conflicts of interest, disclosures of outside employment bribery and other related areas that are included in these Codes.
