In today’s environment, employers face significant monetary and reputational risks from workplace allegations. We assist our management clients in every phase of the process, from strategy to litigation, if necessary. This includes:

  • Counseling clients on managing reputational risks from claims of discrimination, harassment (including sexual harassment), and retaliation.
  • Defending companies against assertions of unpaid wages, including overtime and minimum wage.
  • Initiating measures, including litigation, to enforce restrictive covenants and other contracts.
  • Representing organizations in unemployment hearings.
Harassment/ Discrimination Charges
Harassment and discrimination are two prevalent issues in the modern workplace. When faced with employee allegations of harassment or discrimination, we work hard to assist our management clients in protecting their best interests. In addition, we represent our clients before federal, state, and local human rights agencies, as well as in court, to achieve favorable outcomes.
Wage and Hour Litigation
Our firm represents clients in all types of wage and hour lawsuits, including individual claim and class action claims for misclassification of employees as “exempt,” failure to pay minimum wage and overtime, improper tipping practices, meal period deductions, independent contractor issues and other potential pay practice violations under state, federal and local law.
Non-Compete Litigation
Trade secrets, intellectual property and other proprietary information are among employers most valued assets. In addition to drafting and reviewing non-compete agreements, our firm defends and prosecutes unfair competition claims. This includes improper disclosure of confidential information, breach of non-compete agreements, trade secret misappropriation and tortious interference with business contracts.
Department of Labor Audits
We often represent clients regarding State or Federal Department of Labor Audits. These Audits involve high exposure situations often relating to overtime or misclassification of independent contractors.
Government Agency Inquiries
Several agencies on the federal, state, and local levels are tasked with enforcing laws on employers. Agencies may act on their own, or on behalf of an aggrieved employee. Employers who are approached by these agencies may be asked to respond to an investigative inquiry, or submit to an audit. We have extensive experience in counseling employers through these processes and work with these agencies to ensure the best possible outcome for our clients.
Unemployment Hearings
Former employees often attempt to claim unemployment benefits, which can adversely impact their employer’s contribution rates. We assist our management clients in planning their strategy, help prepare key witnesses and represent the employer at hearings.
Workers' Compensation Penalties
Employers who misclassify employees as independent contractors can often face very costly penalties for failure to remit Workers’ Compensation or New York State Disability Insurance premiums, which is required of all New York employers. Our firm represents employers regarding the reduction of these penalties.
