What Are the New Updates Passed by the New York Department of Labor for 2024?

The New York State Department of Labor approved the wage orders for 2024 and subsequent years. Below is a list of the New York State salary rate increases, the wage increases for tipped workers including food service workers and service employees, and the dates the wages go into effect.

New York State Salary Rate Increases

The New York salary basis threshold for exempt executive and administrative employees will increase as follows:

  • New York City, Nassau, Suffolk, and Westchester counties to $1,200 weekly (or $62,400 annually).
  • The rest of the state to $1,124 weekly (or $58,500 annually).

The New York salary basis threshold for exempt executive and administrative employees will increase as follows on January 1, 2025:

  • New York City, Nassau, Suffolk, and Westchester counties to $1,237.50 weekly (or $64,350 annually).
  • The rest of the state to $1,161.65 weekly (or $60,405.80 annually).

The New York salary basis threshold for exempt executive and administrative employees will increase as follows on January 1, 2026:

  • New York City, Nassau, Suffolk, and Westchester counties to $1,275 weekly (or $66,300 annually).
  • The rest of the state to $1,199.10 weekly (or $62,353.20 annually).

 

New York Wage Changes to Food Service Workers

Effective January 1, 2024, in New York City, Long Island, and Westchester Counties:

  • The cash wage to tipped food service workers will increase to $10.65 per hour.
  • The overtime wage to tipped food service workers will increase to $18. 65 per hour.

Effective January 1, 2024, in the rest of New York State:

  • The cash wage to tipped food service workers will increase to $10.00 per hour.
  • The overtime wage to tipped food service workers will increase to $17.50 per hour.

Effective January 1, 2025, in New York City, Long Island, and Westchester Counties:

  • The cash wage to tipped food service workers will increase to $11.00 per hour.
  • The overtime wash to tipped food service workers will increase to $19.25 per hour.

Effective January 1, 2025, in the rest of New York State:

  • The cash wage to tipped food service workers will increase to $10.35 per hour.
  • The overtime wage to tipped food service workers will increase to $18.10 per hour.

Effective January 1, 2026, in New York City, Long Island, and Westchester Counties:

  • The cash wage to tipped food service workers will increase to $11.35 per hour.
  • The overtime wage to tipped food service workers will increase to $19.85 per hour.

Effective January 1, 2026, in the rest of New York State:

  • The cash wage to tipped food service workers will increase to $10.70 per hour.
  • The overtime wage to tipped food service workers will increase to $18.70 per hour.

 

New York Wage Changes to Service Employees

Effective January 1, 2024, in New York City, Long Island, and Westchester Counties:

  • The cash wage to service employees will increase to $13.35 per hour.
  • The overtime wage to service employees will increase to $21.35 per hour.

Effective January 1, 2024, in the rest of New York State:

  • The cash wage to service employees will increase to $12.50 per hour.
  • The overtime wage to service employees will increase to $20.00 per hour.

Effective January 1, 2025, in New York City, Long Island, and Westchester Counties:

  • The cash wage to service employees will increase to $13.75 per hour.
  • The overtime wage to service employees will increase to $22.00 per hour.

Effective January 1, 2025, in the rest of New York State:

  • The cash wage to service employees will increase to $12.90 per hour.
  • The overtime wage to service employees will increase to $20.90 per hour.

Effective January 1, 2026, in New York City, Long Island, and Westchester Counties:

  • The cash wage to service employees will increase to $14.15 per hour.
  • The overtime wage to service employees will increase to $22.65 per hour.

Effective January 1, 2026, in the rest of New York State:

  • The cash wage to service employees will increase to $13.30 per hour.
  • The overtime wage to service employees will increase to $21.30 per hour.
